Further, the evidence clearly supports the finding that Mr. Lommatzsch negligently operated his PWC at the time and that his 300 pound PWC not only struck the PWC that Nicholas was riding, but rode over the top of Nicholas’ PWC and struck him directly in his chest. The severe impact caused Nicholas to lose consciousness and knocked him face down in the water. Further, the impact resulted in Nicholas sustaining numerous severe fractured bones and significant lacerations. As such, we have no doubt that a jury will find both your insureds liable for Nicholas’ injuries and the resulting substantial damages that he sustained as a result of their negligence. On the date of August 14, 2015, Nicholas and Mr. Lommatzsch were guests of Mr. Piazzi at his lake house on Pioneer Lake in Conover Township, Wisconsin. Nicholas and Mr. Lommatzsch assisted Mr. Piazzi and his son, Brian, with yard work around the house.
