    Faneuil Hall Case Study

    • 809 Words
    • 4 Pages

It is unlikely that Sandy Banks will be able to recover damages from Faneuil Hall. There are three reasons why a court will not hold Faneuil Hall liable for negligence. First, the discolored banana peel may have been dropped by another customer. Second, there weren’t any Faneuil Hall employees present at the time of the incident. Third, because the incident occurred after the employees cleaned and there wasn’t a recent inspection, Faneuil Hall couldn’t have reasonably discovered the banana peel. Citing Massachusetts case law, a defendant may be held liable for negligence when failing to remove a banana peel if its appearance shows that it had been on the floor for a long period of time and either an employee of the defendant was present, the defendant should have reasonably discovered it by a recent inspection, or nobody else could have placed it there. Goddard v. Boston & Me. R.R. Co., 60 N.E. 486 (Mass. 1901); Anjou v. Boston Elevated Ry. Co., 94 N.E. 386 (Mass. 1911); Mascary v. Boston Elevated Ry. Co., 155 N.E. 637 (Mass. 1927); and Scaccia v. Boston Elevated Ry. Co., 57 N.E.2d 761, 765 (Mass. 1944). In Goddard, the facts exhibit evidence that there were multiple passengers on…

textbooks. Such as the Boston Massacre site, Old North Church and Quincy Market. At approximately 5:45 AM we departed from Slocum and boarded our bus and began making our four hour journey to Boston. Along the way at around 8:00 AM we stopped at Dunkin Donuts and ate a light breakfast to fill our stomach up until we got to Boston. The trip there was relatively lethargic with everyone catching a few z’s here and there. As time ticked on slowly, at around 10:30 AM we made it to to our destination.…

orphanage: Wendy McGuire, 8, Jeremy Nichols, 11, and Samuel Allard, 8.” I drop the newspaper. I don’t fuck with haunted orphanages. That might be the last thing I fuck with. I run out of the office but forget which way to go. My instinct tells me left so I take it. And then another left. I find my way to the spelling room, but something catches my eye. I look at the chalkboard that displayed roughly seven words last time I checked. The only word on the board now is “help”. I turn to sprint down…

The hallway is lit by a single light attached to the middle of the popcorn ceiling. There used to be two lights but one bulb flickered and died leaving the hallway dim. The popcorn ceiling is picked off and gone in some spots, mostly around the light and close to the walls. There are also a few tan stains that are darker around the edges and lighter almost white as they go in. The stains might be water stains from who ever lived in the house before. The flooring in the hallway is a worn dark…

“Basically, why are you here? I think.” I asked a final time, and Hugh took a closer look inside the cell at the man, his face rested against the bars. Hugh showed no fear. The man leapt up and took the notepad from the rock. He scurried to the puddle, fiddling for the pencil which lay submerged in the filthy water. I urged him to talk to me. “Ne!” he harked back at me, as best he could. His mood had changed. He pulled his hand away from the puddle clutching the pencil, and he scribbled…

quiet that comes with the snowfall when every living animal is hiding at home where it’s warm. The Dungeon looked like hell but felt like Heaven. This was one ritual that she didn’t understand the point of. There were many in her community, all of which had practical purposes. This one was one of the more ridiculous ones, sending children to this hallway and then not letting them out until they passed the criteria and were allowed back home. They had to wander these halls until the elders or…

Jemma Henley walked down the high school’s corridor and turned. After a short walk up the stairs, she was already out of breath. She looked down to see the small box protruding out of her chest that kept her heart rate normal. Walking wasn’t simple for kids like her. Her v-neck t-shirt showed just the top of a scar that ran down her chest. Sighing, she continued her long walk to her classroom. Jemma checked her watch and looked around. Although she had gotten out of class as quickly as…

Situation when I treated unjustly, and how I restored equity. One situation where I thought I was treated unfairly was when I worked at the airport lounge over the summer. It was my first job in the USA, thus I was excited, and tried to give my best effort on my work so that I could learn something. I was younger than all of my co-workers, and I always tried to follow their instructions and helped them whenever they ask for. However, I had some awesome co-workers, but over time I observed some…
