Administrative Law in Education Administrative law refers to the branch of law which governs the creation and operation of government agencies at the federal, state, and local levels. These agencies are delegated power by Congress and act as agents to carry out the statutory law. In other words, it is the job of legislative bodies to come up with statutory laws and agencies to come up with specific regulations to carry out the law. It is with upmost importance government agencies must draft and execute their regulations without stepping outside the Constitution or statutory law.
The Texas Education Agency (TEA) is an example of a government agency who is responsible for overseeing the laws and regulations of education in the state. In the state of Texas, the Texas Education Code (TEC) includes all the laws and rules passed by the state legislature. The TEA must uphold these laws to ensure public education operates effortlessly. The TEA must put specific measures in place to ensure these laws are being upheld in the state.
Federal Administrative Law The Americans with Disabilities Act (ADA) was signed by president George H. W. Bush on July 26, 1990. Overseen by the U.S. Department of Justice Civil Rights Division, the ADA prohibits discrimination based on disabilities and ensures people with disabilities have the same opportunities as everyone else in the United States.
