It can be very easy to say that art is considered a form of free speech, which is protected under our Constitution’s first amendment, however, free speech is not absolute, and the Supreme Court has the right to ban explicit works of art. This can be seen as a real problem, since art is very subjective, and everyone interprets it differently. So, the real question is, where is the fine line between art and offensiveness? Currently, according to the Supreme Court, art is seen as offensive “if an average person applying contemporary community standards would find that it appeals primarily to prurient interests, depicts sexual conduct in an offensive way, and lacks serious artistic value” (209). Because of all the pressure from conservative organizations, in 1996, following the Mapplethorpe controversy, congress reduced funding for the NEA and grants for visual artists were completely eliminated. Ever since then, the functionality of the NEA has never returned to the way it was before. In my opinion, I do not believe the NEA should be eliminated. I think a lot of art that is considered “inappropriate” is intended to grab the public’s attention and is supposed to be controversial to send a message to society. There are many government programs that are funded with the help of citizen’s taxes, and so the amount of taxpayer’s money that would goes towards the NEA is a very small percentage.
