Keeping with the ACA, Congress amended the law related to workplace wellness programs. Workplace wellness programs that provide incentives for completing a health risk assessment are a form of participatory programs, which some say raises legal and ethical concerns when employers assess penalties for not completing a health risk assessment, raising questions about the voluntariness of such a program (Pomeranz, 2015). Employers ' exercises and the federal departments ' guidelines conflict with the present interpretation of the ACA by authorizing employers to penalize employees who do not complete a health risk assessment. The subdivisions ' regulations may be construed as conflicting with Congress 's legislation, which mentions punishments only for health-contingent wellness programs. Furthermore, the supervisory protections for employees applicable to health-contingent wellness programs do not apply to participatory programs. According to my research, Congress or the federal agencies ought to address the conflict between employers ' practices, the wellness regulations, and the ACA to consider supplementary protections for employees. Employers can evade ethical and legal complications by proposing voluntary programs with positive incentives for all employees (Pomeranz, 2015).
