“We hold these truths to be self evident that all men are created equal, that they are endowed by their creator with certain unalienable rights, that among these are Life, Liberty, and The pursuit of Happiness.” This first line of the Declaration of Independence states that all human beings are equal and have certain rights guaranteed to them. Everyone should have equal freedoms and no person should be discriminated against. However, we live in a world where this is not always true. Not all people are given their full rights; people such as the mentally disabled. The mentally disabled are having their rights infringed upon, this will be proven from their general Welfare rights being taken away, data, the Parental Rights, and a primary source.
“General Welfare is the concern of the government for the health, morality, and safety of its citizens.” (legal-dictionary.thefreedictionary.com). The general Welfare of people with intellectual and developmental disabilities is being taken away when the person is unable to decide where they can live. It is taking a person 's right away when they are forced to leave their home and go to a home for the disabled or a nursing home, without their consent. This is taking away their freedom of speech, to choose where they want to live. This problem was put forth in the 1960s in the Independent Living Movement, where people who were physically disabled fought for their rights to live independently. They argued that people with…
