On 10/25/17, at 1900 hours, in Durango 8 located at 3225 W. Gibson Ln Phoenix AZ 85009, Inmate Rubio, Daniel T391297 informed Officer Mossman B3777 that he was the victim of an alleged PREA violation while he was housed in Durango 9. Officer Mossman immediately removed Inmate Rubio from the housing unit for his safety and notified a supervisor.
Inmate Rubio was taken to the Durango Medical Clinic by Officer Encinas B3226 where he was evaluated by RN Anthony 1247H. Inmate Rubio was cleared to be re housed at 1922 hours. A Mental Health appointment was scheduled for Inmate Rubio. Inmate Rubio was offered Administrative Restrictive Housing, but refused. He signed an Administrative Restrictive Housing refusal form. I read him his Miranda Rights from a MCSO standard issue Miranda Rights Warning Card. I asked him if he understood his rights and would voluntarily answer my questions? Inmate Gallegos replied “Yes” to both questions. I asked him if he touched another inmate in a sexual way in Durango 9? He replied, “No.” I asked inmate Gallegos if he touched another inmate in a way that the other inmate did not want while he was housed in Durango 9? He again replied, “No.” I asked Inmate Gallegos if he touched another inmate’s genitals? He replied, “No.” I asked Inmate Gallegos if he attempted to touch other inmates genitals? During the time viewed Inmate Gallegos and Rubio appeared in camera view several times, but they could not be observed sitting next to one another. The only time both inmates were observed together is 0221 hours between rows E and F. The conversation occurred between 0221 and 0227 hours. Two other unidentified inmates (one Hispanic the other White) were present during this conversation. At 0227 hours, all of the inmates walked away, but it could be seen that inmate Rubio patted Inmate Gallegos on the back before walking
