Through the dictation of healthcare, the government is far overstepping their boundaries. As defined in the Tenth Amendment, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people (“Bill of Rights”).” Since the right to mandate healthcare is not a power given to the government, it is therefore a violation of the Tenth Amendment and hence unconstitutional. Similarly, is the existence of the welfare system. Through the predefined Tenth Amendment, welfare is not covered as a power of the federal government. The Executive Branch has begun to take on the responsibilities of Congress. Since February 1947, the United States has not declared war. Despite the existence, of the Korean War, the Vietnam War, the Iraq War, and the Afghanistan War, these wars were not declared; instead, the Executive Branch can command troops with Congress approved funds. However, the result is an act equal to that of a declared war. Since no declaration of war exists for these actions they are ergo unconstitutional. In Article I Section 8 of the Constitution, the power “To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water; (“Bill of Rights”)” is granted to Congress whilst no power mentioning war is granted to the Executive Branch.
