There has been a certain defense used by criminals that claim that they are mentally ill. This defense is called the Insanity defense. The insanity defense is used in court in order for the accused to justify his or her actions. The defendant can be found not guilty by reason of insanity. They can be found not guilty, but they usually have to serve time in a mental institution. According to Steven Probst, Educational Services Librarian, “Insanity is a legal term for any mental disease or defect severe enough to prevent someone from being legally responsible for his or her actions”. A mental illness is a disorder that can affect a person’s mood, thinking, and behavior. This defense is not utilized in the courts much, but there are people who question if it should even exist. The insanity defense has already been abolished in four states which are Idaho, Utah, Montana, and Kansas. However, the insanity defense should not be abolished in the rest of the states, because it serves a moral purpose to the criminal law.
There are people who disagree that the insanity defense should not abolished. This is because there are certain beliefs that others have of the defense. Many people agree that each criminal should face time in jail for their wrong doings. No matter what excuse they have, their crime cannot be justified.
