First Amendment and Religious Expression

The first amendment is forgotten about and most of the time not cared about in the real world. Back in the day, people could express how they wanted and what they wanted. But now a-days, its like you cant even step outside without getting judged, someone hating you or being offended by what you are displaying or doing. In some cases, the court has agreed with the victim and in others, they have disagreed with them. I am about to give you examples, reasonings and other information about this. People are saying that others shouldn't be allowed to display their religious symbols or religious views, publicly. Then there are people on the other end, who do think that we should be able to display those

The courts opinion could change within the next year, and most likely will, as many people will argue for their rights. Many holiday displays are banned and unconstitutional. “Lynch v Donnelly”; He asked the court to consider the first amendment, did it prohibit displaying religious symbols from being set up on public places? In some states, counties and towns, this is true and in others, it is false. The judge said that it is okay to have Saint Nicholas, but could not have other religious symbols. Although, the chief justice allowed Lynch to keep the creche displayed. The court agreed that the display was constitutional, and they could keep the display. The court officially rules that as long as there is overall agreement with having a religious display, it can stay if it is …show more content…
I think that we should be able to express what we believe, as long as it is on our own terms, not in a public place, cause then it just causes a bunch of arguing, cops get involved, then if you are really serious about it, it goes to the court and you’re wasting the courts time when you could just be civil about it and respect everybody else opinions and keep it to yourself. If you wanna worship Jesus, worship him. If you want to believe in and worship Judaism, by all means, worship it. You have that legal right to do that. My opinion is going to the other side now. What I don't understand is why people can’t just mind their own business, like, if you don't like something, don't look at it or don't listen to it. Why does everything have to be so complicated, that you have to go to court, just because you don't like something? It makes no sense. The first amendment isn't really protected anymore, now-a-days. If you say something that someone doesn't like and they speak up about it, saying that it offended them, you’re the bad guy. Freedom of speech, isn't free. Religious expression isn't free. So, what is the

When the court ruled that Phillips had to bake a cake for Charlie and David, he did have his First Amendment rights violated. In the future, the court should consider a different ruling, such as a fine and allow people to run their business in a way that doesn’t violate the Colorado Anti-Discrimination Act, rather than forcing him to provide the service. My decision would support the reasoning that people can have their own beliefs under the First Amendment, as long as they do not violate the rights of another. My decision would not force Jack Phillips to make wedding cakes for same-sex couples unless he is making them for heterosexual couples; he has the decision to make wedding cakes for everyone, or for no one. This ruling supports that the Civil Rights Act of 1964 and the Colorado Anti-Discrimination Act are…

Texas vs. Johnson (An analysis of the supreme court case Texas vs. Johnson and the current repercussions of the decision) The first amendment protects many of our basic rights such as freedom of speech, freedom of religion, freedom of the press, etc. The framers of our constitution left a broad wording to leave room for our country to grow and change as time went on. One of the adjustments our country has made over time is to define the actions and words protected under the freedom of speech. There are three basic categories of free speech; pure speech, is communication only through words, speech plus is speech plus an aid such as a sign or a chant, and symbolic speech, an action that communicates meaning without the use of words.…

Being a nation requires the citizens to accept that there will be different opinions revolving around religion, and the government rules based on the best interest of the people. In this court case, the US Supreme Court only ruled this ruling to help the students and parents of their state. This US Supreme Court ruling was fair and just. The law did not violate the US Constitution or the New Jersey Constitution; it did not force religion on any citizen of the state, nor…

Today I’m here to express my views on the U.S. vs. Fields a very distinct and intriguing case that involves the topic of free speech. First we have the defendant Abel Fields who was convicted under the Stolen Valor Act, after Mr. Fields portrayed himself claiming that he had “military experience” claiming he had a Purple Heart, also the Medal of Honor, Navy Cross, and even the Air force cross. This made him believe that it gave him the right to speak with authority on the issues but these claims were false. Abel Fields appealed his decision to the court, stating that he viewed the Stolen Valor Act as unconstitutional and believes that his right to the first amendment was being violated. Field’s prosecutors argue that even though Mr. Fields…

Donnelly, Lynch, like Winnit wanted to put up a Christmas display located in the city's shopping district. The creche had been included in the display for over 40 years. Daniel Donnelly objected to the display and took action against Dennis Lynch, just like the officials did by taking down Winnit’s statue. The Supreme Court decided that there is no violations of free exercise and the Supreme Court held that the symbols posed no danger of establishing a state church. Therefore, leaving both statues up would not violate freedom of exercise, but if they allow one statue they will have to anyone to put up a statue.…

Freedom of expression is a uniquely American tradition, at least to the extent we have here. Amy Witherbee, a researcher who studies how democracy and censorship go hand and hand said “At the core of censorship is always a parallel belief in the ability of an idea to alter lives and change nations. The challenge is to let those ideas wreak their havoc, and trust in our capacity as the citizens of a democracy to make of the damage something better than what was there before. If, on the other hand, we close down the arguments, retract the controversies, and avoid the challenges, then what we have is not a real democracy, but a nation afraid to lead itself” (Witherbee Par. 12). The First amendment is in place to protect citizens from censorship.…

People should be able to say what they want to say, do what they want to do, and believe in what they want to believe in, as long as it causes no harm. This sort of freedom becomes a moral responsibility as it holds great power. For the span of mankind, humans have still yet to solve this unanswered puzzle of how to please everyone while maintaining control in the community. It may have to come to the point where even though people should be entitled to ultimate freedom, they have to realize that every cause cannot be won, and that they cannot have control over everything. The clashing of one person to the next prevents this ideal world that has yet to be seen.…

Freedom of speech is a privilege all Americans share. A person can state whatever they please, so long as it doesn’t cause a clear and present danger, without government interference. The idea that someone can legally think, be, and say whatever they want is what lead millions of immigrants to form the U.S. back in 1776 and is the same reason people fight for their right to live here today. Thanks to information being so accessible in this digital age, individuals are told that they are allowed and to study and form an educated opinion. This comes with one catch.…

The first amendment of the constitution is the right of free speech; throughout our history the first amendment has been interpreted in a number of ways. Despite this fact all Americans agree that this is one of our most important rights, and lays the foundation for our nations core beliefs. The first amendment is a short statement “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” (1) Though it holds a great deal of power, it upholds strong personal values, and sets a precedent for the future of our country.…

Corruption on Earth is the norm, no matter what the government style. Our 2050 Martian colony will embody the best of historical government styling from Earth. To avoid government corruption in our colony, I will establish a royal president, the king or queen, and an elected parliament to bring fairness plus tradition, flare, and personality to the government. The best of socialism will be maintained through a strongly regulated and funded health care, education, and public service programs. Because I value each citizen 's constitutional values, I plan to create laws to advocate for freedoms of speech, press, and expression as the best of the democratic government style.…
