Chief justice Rehnquist was a right wing republican with the ambitions of immediately putting the brakes of the excesses of the warren court, while maintaining the majority interest of the people. In other words, this was the end of the progressive era for black Americans. In my opinion, the court used a strategic reversal tactic, “Make America great again” force, to eliminate the remedies of the progressive era. At this time, the political and societal climate shifted to a more conservative feel, the presidency was republican, and whites were enraged with the amount of time focused on Black issues. Many believed that the Black issue had already been dealt with and there was a need to move on to other, more important issues. All of the previous listed components all took part in the transition of the court and its decisions. Thus, the Rehnquist court took the interest of the majority into full effect. Rehnquist politicized the Supreme Court and moved the court and the country to the right. His rulings promoted a policy of New Federalism in which more power was given to the states at the expense of the federal government, allowing states to go back to their old racist ways, and get away with it. Unfortunately, America saw no shift in the court. The Roberts court is considered more conservative than the preceding Rehnquist Court, as a result of the retirement of moderate Justice Sandra Day O'Connor and the subsequent confirmation of the more conservative Justice Samuel Alito in her place. This was no surprise due to the majority of conservatives serving in the house, senate, federal judiciary, and the presidential seat. This also marked a time where the majority was extremely satisfied with the out resulting from the Rehnquist Court. Along with the beliefs that America has now entered a post racial society. As a result, cases regarding race and discrimination continued to be viewed with the strictest scrutiny, affirmative action was disappearing, and the civil rights act, bussing policies, and policy’s surrounding housing, and institutional segregation were dismantled as well, completely leaving Black Americans shocked, uncertain, and stuck in a place of nihilism. 50 years to today, the nature of the problem remains the same within Black Politics, the system of the Supreme Court was considered to be untrustworthy and fails to acknowledge or benefit the black community. The nature of the problem facing Blacks remains the same, and the nature of the system as it relates to the blight of Black in this country reams the same, thus questioning the true progression of Blacks in America.
