The Occupational Safety and Health Administration created by Congress in 1970 is part of the United States Department of Labor. It was created to ensure a safe, and healthy work environment in the private sector for employees. This is achieved by training, education and assistance. Unfortunately, violations occur that result in fines. Below are three cases in the last three years.

1. On 8/1/17 Piedmont Service Group, Inc in Richmond VA received one violation for ‘head protection’ and had until 8/21/17 to comply. The initial penalty was $4, 225.00, and the current penalty is $2, 113.00. The status of the case is currently closed with an informal settlement.

On 7/25/17 FDC Contractors LLC in Norfolk, VA received three violations for ‘head protection’ and ‘duty to have fall protection’; however, no date to comply was issued. I am wondering if the date to comply (abatement date) was not issued because this employer is a repeat offender. The initial penalties totaled $5,760, and the current penalties total $2,880. The status of the case is currently closed with an informal settlement.
1926.100(a) Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.
1926.501(b)(13) "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of

    Espinoza stated that on the claimant’s LDW 11-25-2015, she was told by Supervisor Navarrete that he had information from the claimant showing that he had a pre-existing industrial back injury.
