Hello your honor, members of the jury. I am Marim Ibrahim and I will be representing the accused, in the case of Her Majesty the Queen against Wally Brogue. My defendant has been accused of committing first degree murder in the death of Mr. David Bennings on July 14th 2013. This is the case of a caring, optimistic man who simply wanted to do the right thing. Mr.Brogue did not commit this crime. He was naturally upset over his brother having been incarcerated for a crime that Mr.Benning had committed. As a teacher and counsellor, Mr.Brogue believes strongly in the power of talking things out and as a result went to Mr.Bennings apartment in hopes of convincing him to turn himself over. Moreover, they are anticipated to express their concern over Mr.Brogue’s well-being as they were worried about what Mr.Benning might harm him. I will additionally be calling the accused, Wally Brogue, to the stand.Mr.Brogue was the only one there at the time who was not under the influence of marijuana and will be anticipated to share with us the events that truly unfolded that evening. He will most probably tell us how he went to the apartment with the intent of trying to convince Mr.Benning to turn himself in. He will also be anticipated to testify that Mr.Benning was highly intoxicated on marijuana and alcohol at the time. When Mr. Benning charged at him, my client step out of his path and the uncoordinated Mr.Benning fell over the railing to his unfortunate death. This was merely a man who wanted his brother to be safe and wanted the real criminal, Mr.Benning, to do the right thing. Furthermore, i want you to place yourselves in the position of the accused.If you were indeed planning on murdering Mr.Benning, wouldn’t you have gone with a weapon to kill him
