On March 2, 2018 at approximately 1929 hours, I observed a silver Mercury utility vehicle bearing Florida tag JITE29 traveling south on Port Richey Village LP approaching the intersection of Richey DR in Port Richey, FL. The vehicle passed a posted right turn only sign, but made a left turn onto Richey DR in violation of the posted traffic control device.

I conducted a lawful traffic stop on the Mercury and made contact with the driver. The driver was identified by his Florida identification card as Joseph Alec Kazmar. As I was speaking with Joseph I could detect the strong odor of marijuana emitting from the interior of the vehicle. An NCIC / FCIC check was conducted, which revealed an active warrant (PRPD Case 2018-0282) out of Columbia County, FL. The NCIC / FCIC check revealed the following information;

    By neglecting the opportunity to observe the mobile home for ongoing criminal activity, law enforcement deemed the anonymous tip appropriate evidence to conduct a search, and proceeded to do so. The case of Navarette v. California, 572 U.S. __ (2014) further analyzes the weight of credibility from an anonymous tip, while also noting the importance of surrounding circumstances.
