INTRODUCTION:

This case involves the suspect being arrested for public intoxication and unable to care for himself in violation of PC 647(f)-Public Intoxication. The suspect also had two outstanding arrest warrants.

INVESTIGATION:
On 04-11-17 at approximately 2132 hours, I responded to 154 S. Euclid Avenue #201 regarding an unknown disturbance. The Reporting Party, Alice Mayweather advised dispatch that her children’s father, Yuvivilon Howard was refusing to leave the above location and had been drinking, NFD. Shortly later, Mayweather advised dispatch that Howard left the residence. Mayweather described Howard as a male Black, wearing a black jacket, grey shirt and black jeans.

I smelled a strong odor of an alcoholic beverage emitting from Howard’s breath as he spoke. I noticed that Howard was swaying approximately one to two inches from side to side. I also observed that Howard’s eyes were watery and bloodshot. Howard admitted to drinking one beer and two shots of Vodka earlier during the evening, NFD.
Based on Howard’s objective symptoms of intoxication, I formed the opinion he was intoxicated and unable to care for himself in public. I handcuffed and arrested Howard for PC 647(f)-Public Intoxication. The handcuffs were double locked. Officer Austin conducted a records check on Howard, which revealed two outstanding arrest warrants (see attached printouts).
Incident to arrest, I searched Howard and found an open 200ML bottle of Barton Vodka 40% ALC./VOL. in his left front pants pocket. I retrieved the bottle which was half full. The Budweiser beer can was half full and cool to the touch. I took a photo of the bottle and can, which were later uploaded into VeriPic (see attached photo).
