The purpose of this paper is to perform a critical analysis of the New York State Division of Human Rights (“Division”) by identifying the Division’s performance issues and proposing a plan of action (“plan”) to solve the most critical issue. This paper is organized in three parts. The first part of this paper will provide a description of the Division’s mission, goals, objectives, organizational structure, operations, and stakeholders. Moreover it will identify and describe two performance issues faced by the Division. The agency’s goal is to enforce the New York State Human Rights law (“NYSHRL”) (Division, n.dc & Division, n.dd). Moreover, their objectives involve increasing their social media presence and improving the timeliness of their investigations. The NYSHRL states that investigation must be completed in 180 days. Furthermore, the NYSHRL prohibits discrimination in the areas of employment, credit, housing, education and public accommodations on the basis of age, race, creed, gender, disability, arrest record, marital status and national origin (Division, n.de). The Division has jurisdiction over discriminatory complaints in these areas. The EEOC and HUD have contracts with the Division to investigate a certain number of cases each year (Division, n.dd). Moreover, the EEOC tracks the performance of the Division and provides recommendations. When complainants file complaints with the Division they can dual file them with HUD or the EEOC. Dual file means complaints received by the Division can be simultaneously investigated by the EEOC or HUD.
