There are many legal ramifications imposed on local education agencies, known as public schools, which are complex and often difficult to adhere to. Some of these laws are so ambiguous that even the US Supreme Court cannot get them right, as indicated by Public Interest Law Center of Philadelphia (n.d.). This often exacerbates the litigation process going on for decades, which exhausts many resources and usually end in settlement agreements. Therefore, it is an arduous and daunting task imposed upon public schools to decide which laws are applicable for each specific individual with special needs.
These types of laws place an immense hardship on school districts due to the lack of transparency and potential funding issues that arise from budget impasses. Abstruse laws, such as the Developmental Disabilities Assistance and Bill of Rights Act and the Rehabilitation Act, were once enigmatic to most public schools in PA. Hence, where the litigation began for both acts. However, transitional change has taken place over the years and public schools have come to embrace these laws enhancing our compliancy ratings.
