Insubordination:
I would like to start with what Insubordination means. It occurs when an employee or worker or a junior ranking officer fails to accept or obey the direct or specific order of their seniors. It is lesser degree offence than gross insubordination.
Gross insubordination:
Insubordination occurs when an employee deliberately disobeys, or ignores, a legitimate instruction from a superior. It goes to the heart of the employee/ employer relationship. It is an employee's deliberate defiance of your authority and fails to perform a basic duty to be compliant and refuses to follow reasonable instructions. When an employee intentionally ignores or disobeys his employer’s instructions or neglect their orders then gross insubordination happens. This kind of behavior from the employee looks that they are challenging the employer’s authority. When an employer gives lawful instructions to his employee, it is the responsibility of the employee to carry it out and obey them. So, while considering gross insubordination, make sure that the instructions that the employer gave to the employee were legitimate, lawful and safe. If they were not, the employee can prove himself justified in refusing them.
How should an employer deal with gross insubordination?
When an employee disobeys his employer, the first reaction of the employer is usually to dismiss him or her. But this is not the correct way of dealing with gross insubordination from the employees. Before dismissing, the employer should ask themselves these questions:
• Did you communicate the instructions clearly to the employee?
• Did he or she understands all of your instructions?
• Did the employee disobey you intentionally?
• Were your instructions safe and lawful and did not harm others?

For example, he doesn't have the training or competence to obey their instruction.
And the employee did not have any valid reason to refuse. Employer also needs to procure a proof that he gave the instructions and the employee ignored it without any valid reason, and that this kind of behavior was a challenge to your authority. Employer also needs to prove that the employee disobeyed you. The instructions that the employer gave and the employee refused should form a part of the person's job, and should be safe for him/her. Employer statement should not have any loopholes; otherwise the employee can find his right to make a claim against employer.
