However, he does die in the first movie and comes back to save humanity, fitting one point. Though... That is the only point he fits...
The One is also said to rebel against his own creators, the machines. Neo wasn't created by the machines; he was created by human reproduction. Smith, however, was created by the machines; the Oracle to be exact. And he does rebel against the system. When interrogating Morpheus, Smith removes his earpiece, his main connection to the machines. In doing so, he demonstrates that he can choose to ignore his orders unlike the other agents. He even says to Morpheus "I need to get out..." in his chilling robotic voice. Clearly, he harbors the capacity to go against his programming, a key feature of the One.
And here comes the final nail in the coffin: when the One's code enters the Source, the Matrix will reboot. When Neo jacks into the Soure to fight Smith at the climax of the series, the Matrix doesn't restart. If Neo was the One, it'd happen right there. However, he needs Smith's code to reboot the Matrix, which is why Smith loses his final battle. By assimilating Neo as a Smith clone, he puts his code into Neo, who is hooked up to the Source. She needed Smith to become powerful enough to be directly fought, and strong enough to win. However, because of the Oracle's careful planning, this win would become a loss. This is reflected in the Architect's line "You've been playing a dangerous game." He's referring to allowing Smith to become so powerful, strong enough to to best Neo. The Oracle was balancing a lot of dishes by lying to everyone that the One was Neo, and it worked. Well played, Oracle, you were able to fool everyone, even us in the real world for over 20
