The Competitive Range in a competitive acquisition is the range of the most highly qualified offers, from the entire collection of offers, received in response to a Request For Proposal (RFP). In negotiated competitive acquisitions, it is necessary to establish a competitive range per FAR Part 15 if the Government intends to conduct discussions with the offerors. According to FAR 15.306(c), the Contracting Officer is responsible for establishing and determining what the competitive range will be among the most highly rated proposals received in response to a RFP.

Discussions may be required to give the government a better understanding of an offeror’s proposal, allow for reasonable interpretation of the proposal, verify the adequacy of a proposal, or facilitate the evaluation process. These types of discussions are held to identify and address deficient issues of a proposal and lead to the establishment of the competitive range if one is to be established. Discussions held between the Government and the offeror after the competitive range has been established and are held with the intent “of allowing the offeror to revise its proposal” are referred to in the FAR as Negotiations. These types of discussions may include bargaining. Bargaining includes persuasion, alteration of assumptions and positions, give-and-take, and may apply to price, schedule, technical requirements, type of contract, or other terms of a proposed contract.
