The Andersons argued that the 14th amendment states that they have the right not to be discriminated against and Mr. Smith believes that because the 1st amendments states that he has the freedom to express his religious beliefs. He does not have the right to refuse service to the Andersons due to his religious beliefs. It states that no state can make or enforce a law that can take away your privileges or immunities. You also can't deprive a person of life, liberty or property. Federal and state laws prohibit discrimination for being a certain race, sex, religion, and disabilities. Smith cannot use religion as an excuse to discriminate against the Andersons even though we have religious freedom in America. Smith is entitled to his beliefs but since he's running and operating a business to the public, his beliefs does not give him a right to discriminate against the Andersons or anyone else who comes in his store and asks for his services. It simply does not make sense for Smith to provide service to other Homosexuals for numerous occasions and not to the Andersons. He cannot pick and choose who he gives service to therefore his actions are
