One of the most controversial topics that are still talked about today is Abortion, which is the deliberate termination of a human pregnancy. The disagreement that comes from abortion is between two sides, pro-choice and pro-life. Pro-choice people believe that women have the right to make their own decision about what happens to their bodies and have the right to decided to end their pregnancy if they want to. Where the opposing side, pro-life, believes that life begins at conception and that having an abortion is murdering an innocent human being. The conflict between these two sides raises the question; does a constitutional right to privacy protect a woman’s right to obtain a lawful abortion?
The issue of abortion is best examined in the case Roe v Wade. In this case, Jane Roe was a single pregnant woman who lived in Dallas Country, Texas. She instituted a federal action against the District Attorney, challenging that Texas abortion laws were unconstitutional. At this time, the state of Texas was pro-life. Texas’s law prohibited abortions, unless it was to save a woman’s life. The court argued that since she was unmarried and pregnant, she was not able to receive a legal abortion from a licensed physician because her life was not threatened by her keeping the pregnancy and because she was not able to afford to travel to another jurisdiction to have the abortion safely.
