It was initially established by the Constitution of 1845 that succeeded the president of the Republic of Texas office. Today the state of Texas is overseen by the chief executive of Texas (the governor) and run by the other branches of the government, one of which is the legislative. The entire case was brought about through a case action law suit by a pregnant woman, Jane Roe, who believed that the State of Texas' laws on abortion were unconstitutional. These laws in question would criminalize to proceed with an abortion if the mother would not otherwise suffer medical issue. Another plaintiff that Aided Roe in the case is none other than a doctor that was prosecuted prior for violating the state abortion laws, named Haliford. On the other side of the spectrum defending the state of Texas was state attorney Wade. The result of the disposition was that Roe's argument, led by Sarah Weddington, was legitimate and the court judgment was affirmed.…
According to the court cases, undue burden means when the State tries to block the mother’s path from seeking an abortion. What actually makes something an undue burden is when the women have limited choices towards seeking an abortion and cannot abort the fetus after the 2nd or 3rd trimester. In the court case of Roe versus Wade the mother’s right goes down and the state’s interest goes up because the state has the right to protect life and prohibit abortion. If a woman wants an abortion she has to consult her doctor, whether she can or cannot, it’s mitigated. The court case of planned parenthood versus Casey counted the spousal notification as an undue burden because if the mother wants to undergo an abortion, then she has to get a consent…
The case I will be debriefing is Roe v. Wade and the topic of discussion is Abortion. The case made news on December 13, 1971. Jane Roe, a Texas native wanted to have an abortion, however Texas Law did not prohibit abortions, only in the case to save the life of a woman during pregnancy. Henry Wade, the district attorney of Dallas County from (1951 to 1987) enforced the law that prohibited abortion. However, Texas law had been declared unconstitutional in an earlier federal district court case United States v. Vuitch, in 1971.…
Abortion Abortion became a primary issue with the court case Roe v. Wade when a decision was made by the Supreme Court in 1973 regarding the subject. The courts later changed certain parts of their decision with the court case Planned Parenthood of Southeastern Pennsylvania v. Casey in 1992. The cases fought over the rights to receive an abortion and argued the right to do so through means of the Due Process clause of the 14th amendment and the Right to Privacy implied in previous cases. In another court cases involving abortion, specifically Planned Parenthood v. Danforth, the Supreme Court struck down the requirement for women to have parental and spousal consent to proceed with an abortion (Planned). Although it was not stated that notification of an abortion to a spouse or parent. After Planned Parenthood v. Casey court case occurred spousal notification was no longer a requirement for a woman to have an abortion, but no case yet has struck down the requirements for parental notification (Planned). It is a constitutional right for all female citizens under the law to be treated equally. On Friday, June 19, a federal appeals court upheld their decision to implement new restrictions and mandates on Texas abortion locations that will take effect on July 1. The court previously ruled that abortion providers in Texas could be held to hospital-like standards, which would effectively close the majority of abortion clinics in Texas. The reason for the denial of reversal was that the court did not believe the law placed an undue burden on women seeking abortions. The attorneys of abortion providers asked the court to hold off on the implementation of the new law in order for them to begin the appeal process to the U.S. Supreme Court.…
In December of 2015, a women living in Tennessee named Anna Yocca, age 31, attempted to abort her pregnancy in her own home using a wire coat-hanger. Since the pregnancy was 24 weeks along, which is just about the limit to which an abortion will be performed by a clinic, she is being charged with the attempted murder of her unborn child. There are not many details provided in the article about any possible circumstances surrounding the case and there is hardly anything written about the mother apart from the police sergeant, Kyle Evans, bluntly saying that she tried to murder her baby. The baby, who was delivered more than 10 weeks early, was born with several issues, including a very low birth weight and damage sustained to some major organs, one of which was the heart.…
Abortion has been a conflict not only in today's society but in decades leading up to today. There are many possible solutions that can help stop abortion, such as regulating laws, protesting against abortion clinics, and educating people on why abortion is wrong. A solution that can really help our society will be regulating laws and making them more stricter against abortion. This solution is feasible and women who do have these abortions with no circumstances that they should be eligible for the death penalty. Now not only should women just be killed if they are not informed, women should be informed and their should be more public outreach informing these women on how sex and abortion works.…
