To be more detailed, the judges were accused of taking $2.6 million in payoffs from the owner and builder of two juvenile detention facilities; PA Child Care in Pittston Township, Luzerne County and Western PA Child Care in Butler County, PA. The process was made when Ciavarella, as juvenile court judge of Luzerne County, had been placing large numbers of juveniles in detention at those facilities. As noted before, many of the juvenile defendants appeared before Ciavarella without an attorney. The individuals who allegedly made the payoffs were identified as Robert J. Powell and Robert K. Mericle whom both pleaded guilty for federal charges and are cooperating with authorities.
Conahan gets involved when as a president judge he removed funding from the Luzerne County juvenile detention facility, which resulted in the closure of this county owned facility. In replacement, Conahan advocated in favor of the privately owned PA Child Care, and eventually the Western PA Child Care. With his support, the private facilities then received the county contracts to house juvenile offenders who were placed in detention facilities by Ciavarella. In 2004, a county contract of approximately $58 million were awarded to PA Child Care. Once publicized, the closing of the county-owned juvenile facility and the lease of the PA Child Care became highly controversial.
