Introduction
Stop and search is a power used by Police to detain suspected individuals so that the Police can look for weapons, drugs or stolen property. The term stop and search has been defined by Bryant, Bryant and Graca (2012) as ‘’an umbrella term for 19 powers a police officer has to arrest you’’. However to be able to detain someone for a search it is mentioned within the PACE ACT 1984 that an officer must have ‘’reasonable grounds’’ (Police And Criminal Evidence Act,1984).
In recent years, especially since the cover up of the death of Stephan Lawrence the police have been labelled as racist. When it comes to stop and search many black and ethnic minority people say they were …show more content…
In this documentary (BBC Panorama 2003). Within this documentary it followed Greater Manchester Police and the recruitment of racist Police officers. The documentary discovered that the Police service in question recruited officer that were in fact racist and the recruits where not scared to air their views. Within the documentary many of the trainees explained and demonstrated very scary opinions on their hatred of those of opposite colour by using awful language and some even support the extremist group called The KKK, This group has been known for their racists’ attitudes. Therefore it is very scary that the Police has recruited its supporters. Therefore from researching this documentary it can be seen that there is racism within the Police from the beginning of the officers’ time within the service. Therefore it can be presumed that their views do permit racism within the stop and search powers. Stereotyping
Stereotyping has an importance within this report, this is because before the Police and Criminal Evidence ACT (1984) the only way an officer would stop and search an induvial was to stereotype. Therefore before PACE (1984) an officer should simply stop you due to your looks.
Stereotyping is also important to mention within this report as it has been claimed that stereotyping was to blame for the Brixton Riots (1981). Due …show more content…
When researching for this report I discovered an important study conducted by Finnane, (1990) he states ''every level of police work involves choice on part of the police officer'’. Therefore this can be interpreted as the Police have the power to handle a situation and carry out what they believe is the correct protocol. Therefore this can explain how an officer can be racist while using stop and search powers.
Within Police work an officer is allowed to use his discretion to his or hers opinion. Therefore an officer could possibly use it in an incorrect way. This statement can be backed by the panorama investigation called the secret Police man, showed that Police recruits still hold racists views. This can then come out within a stop and search. Due to discretion police can be discriminative during a stop and search as it gives them the freedom to place their opinion on who the stop and search so if they are racist, it would give the officer opportunity to single ethnic minorities out.
