Sutton’s files on the numbers game and the racket that controlled it are even more extensive than they are for many of the casinos. The files are probably more extensive because policy was so widely played. One could place bets for very small amounts and therefore even those who didn’t have the funds to gamble at casinos could play policy. Because so many people played, the profits for those who controlled the racket were astronomical. In his testimony to the Kefauver Committee Sutton says that it was the old musclemen of the Syndicate that moved in to take control of it when it introduced. The situation was ironic because shortly beforehand, his brother had been arrested for gambling related activities. Even during the Kefauver hearings, many members of the Mafia refused to answer simple questions, fearing they might implicate themselves. In one hearing Jack Licavoli said the following “Well senator, excuse me. I refuse to answer all question.” These examples show how even in situations where there guilt is obvious, members of the mafia will make things as difficult as possible. Furthermore, even if lower level members of the Mafia are caught the police had a hard time actually convicting anyone higher up in the ranks since they are removed from getting their hands dirty. This makes for the distinct problem that much of the evidence isn’t immediately clear. It is only after searching through both the primary and secondary sources extensively that the actual power structure begins to manifest itself.
