Human Rights are ‘universally applicable social or material entitlements, essential to fulfill fundamental needs, which individuals can claim from society on the basis of their humanity’. (London, Ravgaven-Baldwin; 2006 22). In the health care sector, health and human rights are ‘inextricably linked’ (WHO dj ajsd ww…), where one cannot be implemented without the other. Kruger violated many of Mr. McGeary’s Patients Rights and Human Rights by disclosing his HIV status without consent. According to The Patients’ Rights Charter, Dr. Kruger violated the right to privacy and confidentiality (Health Professions Council of South Africa, 2008: 1) and in terms of The National Health Act, he too violated the right to confidentiality, as Act 61 section 14 part1 and part 2a-c, states that ‘All information concerning a user, including information relating to his health status, treatment or stay in a health establishment s confidential’ and ‘no person may disclose any information contemplated in unless (a) the user consents to that disclosure in writing; (b) a court order or any law requires that disclosure; or (c) non-disclosure of the information represents a serious threat to public health.’ (2003,). Mr. McGeary’s had not given consent, he was no serious threat to public health nor was there a court order that required the disclosing of his status. In terms of his Bill of Rights, Dr. Kruger violated his rights to Human Dignity, which entails that, his ‘dignity [be] respected and protected’ (Republic of South Africa, 1996: 8). The disclosure of his status to his community may have ostracized him as HIV has stigmas that communities subscribe to thus losing his dignity.
