I too think that having a gun on school grounds is a serious crime. In the case of United Sates v. Lopez it should have only been up to the state to punish him, but that wasn't the case. Lopez's crime should not have been punishable under the Commerce Crime and that was exactly what the ruling upheld. The Commerce Crime had nothing to do with the Gun Free School Zone Act and therefore it was unconstitutional. Great discussion.…
The Supreme Court's decision in New Verses versus T.L.O was that the search was legal and that it didn't violate the 4th amendment. The Court also held that school officials need "responsible suspicion" instead of a higher level of "probable cause" and that such a warrant wasn't needed. There should be "responsible suspicion" since students still have some rights at schools, and without a "responsible suspicion", the school officials would be breaking the Fourth Amendment. Yes, the Supreme Court's decision was the correct one because students should have some rights when at school, but if associated with what could lead to a bigger consequence or investigation, the school officials should be able to search and do what they can without a warrant…
When the privacy of students comes into question there are mixed responses, especially when it comes to the contents of a student’s bag. From the landmark supreme court case TLO v. New Jersey, the privacy students have in school has inevitably come into question. Whether TLO or New Jersey was right, this court case changed the way we look at students and their privacy. Some may argue that students have no privacy in school while others may think they have too much. Has the Supreme Court already decided where they stand on this hot button topic?…
8:05 A.M., Chris is sprinting his down the hall to English, only to find everyone sitting down, staring at the entrance of the room, and the teacher marking everyone but him present. This would not have happened if Chris’s locker had not jammed when he attempted to open it to put his bag inside. East Jordan Middle High School has an issue with the amount of tardies and absences of students. The way to fix EJMHS’s issue is to rewind it’s ban on bags in classrooms, which would also help with other issues. East Jordan Middle High School must change their rule on bags in classrooms because of availability of bags, efficiency of time, and absence of threats.…
The Fourth Amendment does protect individual from being unreasonable search. However, in this case that doesn’t make a difference since this is school grounds. In school there are rule and policy everyone must follow as well. In addition if the school feels that they have reasonable suspicion they have every right to search Jacob locker and book bag if it’s on school property. The main issue here is the school had a privilege to act and they did.…
Kids Have Constitutional Rights Drug Screening is a method for identifying the presence of one or more drugs, also known as drug testing. Children all around America and now in Massachusetts school districts are being tested at random to a drug screening. School nurses are allowed to give a drug test to a student with no reasonable cause or any parent consent if the child were to be a minor.. This might prevent kids to stop and using drugs but it violates one's privacy. The proposal in a Massachusetts school district to drug test high school students is is a violation of students’ right as stated in the Fourth Amendment to the United States Constitution.…
In 2003, Savana Redding is 13 years old, she was pulled out of her math class and was told to undress herself so they could conduct a search on her. The Supreme Court favor the school and said that is legal to do unreasonable searches and seizures, if it is disrupting the learning environment or is found smoking in school environment and the discovery of rolling papers near cigarette in her purse created suspicion that she might have marijuana or if the school has a suspicion, broke a rule, student committed or is committing a…
Keeping weapons out of the classroom and into professionals’ hands removes the risk of students finding and firing weapons. The evidence is clear that having armed security guards cuts response time and keeps children safe without having the distraction to the teachers inside the…
With all of the violence in schools, kids may feel uncomfortable if they see other students or teachers carrying a weapon. This could cause the kids to not feel safe and not want to attend school. Parents would express their opinions quickly. Some parents may support teachers carrying weapons and not students. Some may support neither carrying weapons, but school violence needs to…
A popular solution most schools are coming to is installing metal detectors at the entrance of the school in order to monitor what is being…
Although allowing teachers the right to have a gun on school property will not solve all of the world’s problems it can be a step in the right…
Do you have enough storage space for all your things at school? Well, I don’t. I think St. Francis needs lockers. I think this because the cubbies do not provide enough space for backpacks, textbooks, and other items I bring to school such as books. The cubbies are like the sizes of shoe boxes!…
In America, guns have been a part of the country’s society since about 1607, whether it be war, hunting, protecting your family, it has always been a symbol for many things. The gun control vs. gun rights debate has been an ongoing controversy since the late 1960s, weighing the rights and liberties of the individual citizen against the welfare and safety of the nation as a whole, has always been a precarious discussion. Now, 48 years later, nationwide shootings are occurring on a daily basis. Masses of Americans are demanding the Obama administration to tighten gun laws and are willing to give up their rights for more safety. While in some aspects it is understandable why many want stricter gun control, some Americans do not understand is that…
We should have locker clean out more often because it will keep your locker cleaner and that's important. For example if something doesn't belong the teacher that is checking your locker will say, “do you need that?” Then you will either put it in your backpack or tell them that you need it. If you bring things to school that you don't need it just puts more in you locker.…
