Baron de Montesquieu, an Enlightenment thinker in the early 1700’s, created the idea of “Separation of Powers”, which stated each government is separated into three forms of government: executive, legislative, and judicial branches. Each branch creates a set of checks and balances, meaning every branch must check the other two branches. Checking each branch maintains equal power between branches, providing a way to counteract decisions which are either unjust or unconstitutional by law. If both the government and U.S. Constitution don’t agree on an answer regarding particular issue, it must then be passed through state legislation.
