Frank Trippett, in his excerpt, claims that the increasing count of americans in today's day and age are consistently breaking the law. The author supports his assertion by first explaining the fact that, even though many people only break minor laws, they should still consider themselves as law breakers. He continues by listing minor laws that people break everyday and are careless to the fact that they what they are doing is illegal. The author’s purpose is to make people aware of their actions and make them realize that what they have been doing, though it may be minor, is wrong and they should make better choices. Lon Fuller, while discussing the legal system and the addition of laws, brought up ways that you can fail in making laws. 1) The failure to make laws at all 2) Failure to publicize laws 3) Abuse of Retroactive legislation 4) Unintelligible rules 5) Contradictory rules 6) Rules requiring more than what is humanly possible 7) Frequent changes in the law 8) Lack of congruence between state rules and administration. Fuller believes if any of these failures occurs, the system of rules are no longer considered a legal system. Another site of legal violence is within mass incarceration. William Stunz addresses the violence of the system as focusing on the process over the outcome. He focuses on how the law was put into place to create the desired outcomes, rather than looking at the results to create the law. This focus on the process means there is no inquiry to whether material outcomes of the process are actually just and as such it appears that the system does not want to fix the problem, but rather just emphasize an existing problem.
