Constitutional laws derive from the interpretation of the United States Constitution. The U.S. Constitution establishes the rules and regulations for the American people. As stated in the constitution,
This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding. Therefore, the U.S. Constitution serves as a key provision for the federal and state government. Although the U.S. Constitution does not explicitly mention education, the Tenth Amendment enables states to establish an educational system (U.S. Const. amend. X). Consequently, Texas has the authorization to create a public education system. Since public schools receive federal funding, rules and regulations should follow the U.S. Constitution. The state legislature also serves as a key entity in establishing guidelines for a public-school system. Teachers interact with students daily; it is imperative for teachers to be informed of students’ rights guaranteed under the constitution.
