What are the responsibilities of Officers of the PCBU?

To show ‘due diligence’ and ensure:


- each worker employed or engaged are so far as is reasonably practicable, while at work, safe from injury and risk to health,


- The provision so far as is reasonably practicable of:


• A safe working environment


• safe systems of work


• plant and substances in a safe condition


- all workers are provided with the necessary information and training to enable them to effectively carry out their role responsibilities


- consult with workers who carry out work for the business or undertaking who are, or likely to be, directly affected by a matter relating to WH&S


- Health, safety and injury management performance is an integral component of the business financial and strategic plans


- adequate human and financial resources are available to implement their WHS&IM policy statement


- the management system review of their WHS&IM system for continued suitability and effectiveness

The hierarchy of control is:



Elimination: remove the hazard


Substitution: replace with a lesser hazard


Isolation: install guards / protection etc


Engineering: redisign the machine and task so it can be done another way


Administration: rotation of workers / different rosters / signage etc


PPE: provide appropriate PPE

What is a notifiable incident?


WHS Act 2012

A notifiable incident means:


- The death of a person,


- The serious injury or illness of a person,


- A dangerous incident.



If any of these things happen it should be reported to the technical regulator asap and the commander and ACFO immediately

Duty of care - MFS or business


19 - Primary duty of care


1) A person conducting business must ensure, so far as is reasonably practicable, the health and safety of:


a) workers engaged or caused to be engaged by the person


b) workers who are directed or influenced by the person


while the workers are at work


2) A person conducting a business or undertaking must ensure, so far as is reasonably practicable, that the health and safety of other persons is not put at risk from work carried out as part of the business or undertaking


3) The person conducting the business or undertaking must ensure, so far as is reasonably practicable:


- The provision and maintenance of the work environment without risks to health and safety


– The provision and maintenance of safe plant and structures


– The provision and maintenance of safe systems of work


– the safe use, handling and storage of plant, structures and substances


- The provision of adequate facilities for the welfare of workers at work and access to it


- monitor health of workers and conditions in workplace



20 - Duties of persons conducting a business or undertaking involving management or control:


- must ensure, so far as is reasonably practicable, that the entry and exit to the workplace and anything arising from the workplace does not affect the health and safety of any person.



21 - Duties of persons conducting a business or undertaking involving management or control of fixtures, fittings or plant at workplaces:


The person with management or control of fixtures, fittings or plant at a workplace must ensure, so far as is reasonably practicable, that the fixtures, fittings and plant without risks to the health and safety of any person



The WHS Act of 2012, Sections 27-28, also states that:

1) must use due diligence to ensure an employee takes care of his or her and everyone elses health and safety at the workplace


2) 3) and 4) state that it is an offence to fail to comply with 1) above


Due diligence means to:


- acquire and keep up-to-date knowledge of work health and safety matters


- gain an understanding of the nature of the business or operations and the risks and hazards associated with it


- ensure the person conducting business or undertaking has available for use, and uses resources/processes to minimise or eliminate risk to WHS as part of the business or undertaking


- ensure person conducting the business or undertaking has processes for receiving and considering information regarding incidents, hazards and risk, and responds in a timely way


- comply with obligations to ensure employees comply with examples under the act such as :


• reporting notifiable incidents


• consulting with workers


• ensuring compliance with notices issued under this act


• ensuring provision of training and instruction to workers about WHS


• ensuring WHS representatives receive their entitlements to training



28 Duties of workers:


While at work workers must:


• take reasonable care for his or her own WHS


• take reasonable care directions do not adversely affect the WHS of other people


• comply with reasonable instruction to ensure obligations under the act are met


• Cooperate with WHS policies or procedures that are in place
