four elements of Valid consent

- voluntary : not talked/forced into the procedure by staff or family


- specific to procedure: exactly the procedure not & maybe some other bits


-Informed : in language a lay person would understand and the consequences of the surgery. decreased range of motion


- legal capacity/compentent: no deficits. e.g. language;age;mental health;dementia.

doctor must explain all risks and procedure but does not have to witness the consent


-in an emergency the doctor can operate on a person under the doctrine of necessary - no consent is required


- breach of duty of care- any incident where reasonable care was not taken : including wrong treatment, wrong information, neglect or acting outside your area of competence. failure to warn risks of surgery.

roles a nurse in relation to consent

1. check consent is signed


2. ensure patient understands the procedure


3. if patient unsure/confused wishes to withdraw consent


4. inform patients surgeon with the reason for refusal or area of concerns of your patient


5. reasons for not being able to provide consent e.g. language, dementia, pain,
