Dennis Dinardo is going to be prosecuted for reckless disregard to human life because of the amount of danger he put everyone in. This is the right way to go because he was correct that Washington had a gun and was running with a purpose after the shots were fired. Charging Dinardo with attempted murder would be too much because he was right to take the shots he did and not charging him would not be right either because he fired multiple shots into crowd of chaos. The race of both men is not important to the story because that is not the reason Dinardo shot Washington, he shot Washington because he felt as though he was in danger of being shot. The second transit officer who stopped after he heard Dinardo yelling from the train should have pulled off his badge and shown it to him to prove that they were on the same side of the law.…
When police are conducting a lineup or a photo spread all suspects should look similar in features that the witness described in their statement. The individuals should have similar age, hair color or length, as well as other parts of their appearances. In the photo spread the background should not include the inmate number or the height scale during both the photo spread and the lineup (Wells et al. 1998, p.9). Lineups and photo spreads are a very important part in identifying a suspect, but when done incorrectly they can lead to wrongful convictions.…
Although eyewitness testimonies are important, we have to understand the factors that can affect them. The video only talked about a few ways in how Jennifer's could have gotten altered. In class, we discussed seven more factors. These factors are important to look at because…
Communication with detectives after identification impacts on misidentification. After Jennifer selected Ronald at the photo lineup, Detective Gauldin told her “You did great, Ms Thompson”(33). Just like many other victims and witnesses, She subconsciously replaced the image of Ronald with the image she created during her rape. As a result, during the physical lineup, she searched for a face that matched the photo she selected and found Ronald. When the detective told her “ we thought that might be the guy”(37), she was certain she had done a good job and caught her attacker.…
Wrongly convicted individuals will become more common. Attorney client priveledge exists to protect innocent people from being wrongly convicted. In an aff world you would see the number of wrongly convicted individuals increase. (no evidence, just logic.) just because a person is innocent doesn’t mean they are protected from prosecution.…
Instead, the witness must reconstruct the event from memory, which allows the possibility of inaccuracy, even without law enforcement involvement. Despite evidence of flawed traditional eyewitness identifications, eyewitnesses are still used regularly for law enforcement as thousands of suspects are targeted each year based on eyewitness reports. As the U.S. Supreme Court has noted, "There is almost nothing more convincing than a live human being who takes the stand, points a finger at the defendant and says, 'That's the…

Eyewitness identification relies upon the eyewitness memory and the ability for him or her to retain that information and reporting it straight to the police. Memory is considered as evidence because information is being gathered and encoded in memory. Over time the storage holds in the encoded information in the brain until retrieval occurs so the brain can have access to the information. Although memory is not accurate, errors can occur throughout the process of encoding, storage, or retrieval. Even images and sound can deteriorate over time, which makes it hard to recall them back.…

Eyewitness misidentification is the greatest contributing factor to wrongful convictions proven by DNA testing, playing a role in more than 70% of convictions overturned through DNA testing Nationwide. One of the primary reasons that eyewitness error is the main source of wrongful convictions is on the grounds that it is a standout amongst the most effective sorts of proof that can be introduced against a criminal Defendant. Biological aspects of eyewitness testimonies Factors such as Age, sex, or race could be considered biological. The ability to recognize unfamiliar faces increases from childhood to Adolescence grows exponentially, but there is a sharp decline in the individual's ability to recognize faces when the individual turns 50 (Cutler & Penrod, 1995). The elderly can have less precise eyewitness testimonies, which is the reason it's critical to inspect age-related disparities.…

Summary of Picking Cotton Picking Cotton described the story of a rape victim, Jennifer Thompson, who mistakenly picked Ronald Cotton from a photo lineup and then a live lineup as her assailant. Jennifer had earlier assisted police with an Identi-Kit composite sketch that she had felt was not quite accurate but was put out to the public through local news channels to help identify any possible suspects. Ronald Cotton was a name given to police as a possibility. Her perspective of the identification process is one of self- pressure to choose the right suspect; and the trust that the police had the right suspect. She described feeling that it was up to her to choose the right suspect.…
We the survivors are not the true witnesses. The true witnesses, those in possession of the unspeakable truth, are the drowned, the dead, the disappeared. - Primo Levi I chose this quote because of the truth it states. This story is told from different points of view, and they saw everything. Death, life, sickness, and what truly happened, from beginning to end. They give insight to events that most people don’t pay attention to.…
The killing occurred on October 31 at 11:59 PM. 38 persons were at the event, one survived. The interview with the one remaining witness did not go as planned. I asked if she saw the killer and she gave me one of those no-you-imbecilic-bagel looks. I asked if she suspected anyone of being the killer.…
