The officer made the right call because of all the facts that he had learned in the short time since he heard the gunshots. He heard gunshots got off the train and saw two men who appeared to be carrying weapons running toward the other side of the station. Both of the men who had the guns were running with a purpose, Dinardo did not know what that purpose was but he acted because he felt that he and many others were in critical danger.
One witness claims they saw the cop inside stick his hand out the window and fire into the man’s back when he was down and that they were hiding under one of the seats. That witness had just gone through a very stressful and possibly traumatizing situation, so it is possible that more happened that she blocked out of her memory. Also, how well could she see from underneath a seat in the train with all the chaos going on inside and out of the train.
