Different areas of this line of work can be questioned by the law. Dr. Tamer Reilly, licensed sex surrogate through IPSA (International Professional Surrogate Association), suggests sex surrogacy has been legal in the United States since it has been created. She states, “There has never been any confusion on the legality of Sex Surrogacy” (T. Reilly, personal communication, March 1, 2017). On the other hand, according to the Iowa Code 709, sexual abuse can be defined as any sexual act between two people with one person suffering from mental illness who cannot give the proper consent to sexual activity (Iowa Code 709). Sexual activity can range anywhere from touching another person to actual sexual intercourse. Sex surrogates work with mentally impaired patients. Everyone has the right to sexual intercourse. When a client visits a therapist they can be referred to a sex surrogate. If the client goes and does not give proper consent, the sex surrogate however, could be seen as a legal and ethical issue. However, this is not the case; sex surrogacy just so happens to get around that law. In 709.15 of the Iowa Code, it mentions therapists, including psychologists (Iowa Code 709). Sex surrogacy is a type of therapist, therefore seeming that they violate the law there as well. People who are not heterosexual are often not confident enough to engages in sexual practices. Sex surrogacy helps them with that. L. Poelzl (2001) has received that type of help, and she wrote a book called “Bisexual Issues in Sex Therapy: A Bisexual Surrogate Partner Relates Her Experiences from the Field. Journal Of Bisexuality.” In the book she describes her experiences using a surrogate through her life. One point Poelzl (2001) raises is that sex surrogates are a safety net for people to discover what they like sexually. This helps people explore their options. One client, who was gay, came to a female sex surrogate. He was in complete awe with her. He enjoyed looking at her vagina and feeling what it felt like. He enjoyed this because he was quick to learn that he could get an erection from a female as well (Poelzl, 2001, p. 121 ). In the overall end of using the surrogate, the male has learned that he still really enjoys being with men, but he really enjoyed the experience of being with a female (Poelzl, 2001, p. 122). Other experiences could have been different, maybe they ended up not enjoying being with the opposite sex or vice versa. This again goes to show that surrogates are very much so a helping hand to sexually frustrated people. Nevertheless, a prostitute could also help engage people who are sexually confused as well.
