The defense truly had little to utilize in defending Detective McDermott’s conduct in the photograph, but their attempts at explaining the photograph were nonsensical. Detective McDermott admitted he was in the photograph, but had no specific memory of the incident. Identifying Detective McDermott in the photograph though, in my belief, was all the prosecution truly needed. Since it was proven that Detective McDermott was in the photograph, I do believe he was guilty of all of the charges brought against him. It is difficult to identify what motivated Detective McDermott to participate in the photograph. Detective McDermott testified that he only remembered someone telling him to pose for a photo. I believe that Detective McDermott was friends with the other officer in the photograph and that he found the pose and idea humorous. I believe the intent of the photograph was humor and not to be malicious or degrading. Additionally I believe that Detective McDermott may have felt pressured to take the photograph since another officer was already participating and he most likely was prompted to take the photo by another officer. Detective McDermott likely participated as a way to gain approval of those present. Officers often participate in acts as a way to gain other officer’s approval as a way to avoid being ostracized by the department. I believe Detective McDermott
