1. Discharge of firearm by LE towards another person


2. UOF by Officer w/results in GBI or death


3. Sustained finding of sexual assault by an officer towards a member of the public


4. Sustained findings of dishonesty by an officer (reports, etc)

** delay may exceed 60 days of disclosure could interfere with criminal proceedings against the officer or someone else


** if there is a delay, Agency must provide a reason in writing every 180 days


** withheld information must be disclosed WHEN, investigation is over, basis for withholding is resolved, no later than 18 months following the date of incident


** if criminal charges are filed where Force used, Agency may delay until verdict or plea given.


** Agency may delay the disclosure during an Admin Investigation; no longer than 180 days, or 30 days after closing of criminal investigation


** recordings for Frivolous unfounded complaints will not be entertained

Legalizes the use of recreational marijuana for adults


- Allowed adults 21 and over to use and possess marijuana for recreational use, provided:


A. Not more than 1 oz (28.5 grams)


B. Not more than 8 grams of concentrated cannabis


C. Possess, cultivate, use up to 6 living plants in home.


- can smoke in your own home


- must stay away 100 yards from schools


- can’t sell, can’t drive DUI

(01-2018) Custodial Interrogation of Juveniles.


- Juveniles 15 years OR younger, cannot be questioned. LE must contact the PD’s office prior to custodial interrogation.


- Consultation with legal counsel CANNOT be waived by juvenile


- Juvenile can consult 3 ways (telephone, video conference or in person)


- failure to comply by a LE, will result in the judges allowing of statement admissibility, unless:


1. The deputy who questioned reasonably believed the information sought, was necessary to protect life or property from an imminent threat.


2. Deputy’s questioning was limited to those that were reasonably necessary to obtain that information.

Requires when a person leaves a handgun in an unattended vehicle, they:


- must secure it in the trunk


- in a locked container out of plain sight


- or in a locked container permanently affixed


- If no trunk, can store it in locked center console (with a lock)


- Also amended to include locked containers/ locked tool boxes in bed of pickup trucks


Fine is $1000 for a violation

Pregnant and Postpartum Inmates

- operates by ACSO and OBGYN, that all women booked into SRJ will be granted access to OBGYN services.


- Any staff member who becomes aware of pregnant or postpartum inmates claiming or displaying any emergency or signs or symptoms, shall advise the ON CALL DUTY NURSE.


Signs and symptoms:


Any complaint of bleeding, raptured membrane, fainting or passed out, blood in Urine, abdomen pain, possible labor, poise dependency, alcohol dependency, withdrawal, uterus or vaginal bleeding, leaking vaginal fluid, greater than 40 years of age, previous stillbirth, methadone treatment, other conditions


- shall not be restrained unless a great security risk. When transporting or moving not restrained, unless absolutely necessary. Medical staff will remove restraints


- protocol starts in ITR; screened by medical staff within 2 HOURS of arrival


- females have OPTION of taking pregnancy test.


-REFUSALS are documented on a “Pregnancy Testing and Refusal and Release” and they can take it at a later time


-medically identifies inmates have OPTION of wearing Orange armband


-HU are advised of pregnant females and are monitored. If identified, RED DOT in upper corner of custody card.


- Issued a lower bunk on bottom tier from first day of incarceration
