S1 THEFT ACT 1968

Dishonestly Appropriates Property Belonging to another with the intention of permanently depriving the other of it.

DEFENCES TO THEFT

1.Believing you had a right in law to take it


2.Believing had the owner known of the circumstances, they would have consented


3.Appropriates the property In the belief that the owner of the property could not have been found by taking reasonable steps


4. A persons appropriation of property may be dishonest notwithstanding that he is willing to pay for the property.

S8 - ROBBERY

Steals, and immediately before or at the time of doing so, and in order to do so, he uses force on any person. Or puts or seeks to put any person in fear of being then and there subjected to force.

S9A BURGLARY

He enters any building or part of a building as a trespasser and with intent to steal anything in the building or part of the building in question or inflict on any person therein any grievous bodily harm or do unlawful damage to the building or anything therein

S9B - BURGLARY

Having entered any building or part of a building as a trespasser he steals or attempts to steal anything in the building or that part of it or inflicts or attempts to inflict on any person therein grievous bodily harm.

TWOC S12 Theft Act 1968

Without having the consent of the owner or other lawful authority, he takes any conveyance for his own or another's use or, knowing that any conveyance has been taken without such authority, drives it or allows himself to be carried in or on it.

Aggravated TWOC S12 Theft Act 1968

The Conveyance was a Mechanically Propelled Vehicle, that After the vehicle was taken and Before it was recovered:- a) the MPV was driven DANGEROUSLYb) an INJURY RTC occuredc) a DAMAGE RTC occured ( other than to that MPV) d) DAMAGE was caused to the vehicle.

Section 12(6) - Theft Act 1968

A person who, without having the consent of the owner or other lawful authority, takes a pedal cycle for his own or another's use, or rides a pedal cycle knowing it to have been taken without such authority, commits an offence.

Abracting Electricity - Section 13 Theft Act 1968


A person who dishonestly uses without due authority, or dishonestly causes to be wasted or diverted, any electricity from any source, shall commit an offence. 5years / eitherway


Handling Stolen goods - Section 22 Theft Act 1968


A person handles stolen goods if, otherwise than in the course of the stealing, knowing or believing them to be stolen goods he dishonestly receives the goods, or dishonestly undertakes or assists in their;RetentionRemovalDisposalRealisation by or for the benefit of another person, or if he arranges to do so. Eitherway - Indictment 14 years.


Going equipped for Theft - S25 (1) Theft Act 1968

When not at his place of abode, he has with him any article for use in the course of or in connection with any burglary or theft or TWOC

Fraud: Making off without payment- Theft Act 1978 S3

Knowing that payment on the spot for any goods supplied or services done is required or expected from him, Dishonestly, Makes Off, without having paid as required or expected and with intent to avoid payment of the amount due shall be guilty of an offence.

Abuse of Position - Section 4 - Fraud Act 2006


A person is in breach of this section if he- a)Occupies a position in which he is expected to safeguard, or not to act against, the financial interests of another person, b)Dishonestly abuses that position, and c)Intends, by means of the abuse of that position- a To make a gain for himself or another, or b.To cause loss to another


Possession of articles for use in Fraud - Section 6 Fraud Act 2006

A person is guilty of an offence if he has in his possession or under his control any article for use in the course of or in connection with any fraud.

Obtaining Services Dishonestly- Section 11 Fraud Act 2006

A person who obtains services for himself or another by a dishonest act and a)They are made available on the basis that payment has been, is being or will be made for or in respect to them b)He obtains them without any payment having been made for or in respect of them or without payment having been made in full and c)When he obtains them he knows- i.That they are being made available on the basis described or ii.That they might be but intends that payments will not be made, or will not be made in full.
