Federalism

government authority shared by national and local governments

Necessary and Proper Clause

a section of the Constitution that allows Congress to pass all laws "necessary and proper" and gives Congress powers not specifically given by the Constitution

McCulloch vs. Maryland

Maryland wanted to tax a bank, McCulloch didn't want to pay. It was brought to court and national supremacy and necessary and proper clause was used to settle the argument.

Gibbons vs. Ogden

a landmark decision in which the supreme court of the US held power to regulate interstate commerce, encompassed the power to regulate navigation

Printz vs. US

US supreme court ruled that established the unconstitutionally of certain interim provisions of the Brady Handgun Violence Prevention Act.

Nullification

the doctrine that a state can declare null and void a federal law that, in the states opinion, violates the Constitution

Dual Federalism

doctrine holding that the national government is supreme in its sphere, the states are supreme in theirs, and the two spheres should be kept seperate

terms set by the national governments to states for them to obey whether or not they accept federal grants

a decision by a higher power to give permission to violate a law/rule

Devolution

the transfer or delegation of power to a lower level, especially by central government to local or regional administations
