The British North America Act (BNA Act) of 1867 was the law that created and governed the Dominion of Canada. According to Section 24 of the BNA Act, only “qualified persons” could be appointed to the Senate” they then clarified that qualified persons referred only to men. They said this was because that was the way they would have viewed the word when the NBA Act was written. After this Emily Murphy invited Nellie McClung, Irene Parlby, Louise McKinney and Henrietta Muir Edwards to her home with a plan was to send a petition to the Supreme Court of Canada about the interpretation of the word “persons” in the BNA Act. The letter that they all signed asked the following two questions, “1. Is power vested in the Governor-General in Council of Canada, or the Parliament of Canada, or either of them, to appoint a female to the Senate of Canada? 2. Is it constitutionally possible for the Parliament of Canada under the provisions of the British North America Act, or otherwise, to make provision for the appointment of a female to the Senate of Canada?” To sum it up they asked if there any way around the fact that they were not considered persons. This includes Emily Murphy, Nellie McClung, Henrietta Muir Edwards, Louise McKinney and Irene Parlby. These ladies were all activists and accomplished something for women before working together on the persons case. With this dedication, many things in the women’s movement were thanks to these five ladies. This was really shown when Nellie McClung stated, "I am a firm believer in women-in their ability to do things & in their influence & power. Women set the standards for the world, and it is for us, women of Canada, to set the standards high." Here she is stating that she believes in women’s ability to do things, which formulates the thought that if she is thinking this then why couldn’t other believe it as well. Not only did she believe in that, but the other four did as well. Often when people hear Famous Five one particular women comes to mind. That is usually Emily Murphy. She took a big leadership role in the persons case and it was because of her that she realized this issue needed to be addressed. People had suggested for senate, but according to section 24 of the BNA Act, only qualified persons could be appointed to the Senate. At this time, qualified persons only included certain men. With this information and the knowledge that five people could petition against the government and the Supreme Court to change a law in the BNA Act. So that was what she did along with Nellie
