In 2004 the European Union first established a European Agency for the management of Operational Cooperation at the External Borders of the Member States of the European Union ‘Frontex’ . Frontex was created by the Council regulation (EC) 2007/2004 and was adopted on 26 October 2004 and started its operation on 1 May 2005. It is recognised as the European Union border control agency. Frontex was established to facilitate measures relating to the management of EU member States external borders, land, sea, airports and seaports borders to which the provisions of Community law on the crossing of external borders by person apply. Frontex Regulation was however amended in 2007 by Regulation (EC) No 863/2007 to establish a mechanism for the creation of Rapid Border Intervention Teams. Its Regulation was further amended in 2011 by Regulation (EU) No 1168/2011 to enable an effective operation. Many perceive Frontex to be an overarching institution exercising supranational powers.
However, the current European migrant crisis is a big test for Frontex, is being thrust into the front line of European emergency talks and planning but unfortunately failed to cope with the masses influx. According to the Bureau of Investigative Journalism “Frontex is arguably more show than substance-a microcosm of everything that hampering a pan-European response to the current crisis” .
