Argumentative Essay: The Case Of Penny Ann Avery

Improved Essays
On July 29 1985, Penny Ann Beernsten was running that morning like she usually did. She was running the perimeter of the Lake Michigan shoreline when she was brutally attacked and raped by a man. The innocent project stated from police records that based on a physical description of Beernsten’s attacker, police were able to provide pictures of nine men. Steven Avery was among those men, and was arrested the following day. Truth in Justice stated that “sixteen witness, including Avery’s family and friends, a cement contractor, and clerks at Shopko, along with store receipts from Shopko corroborated Avery’s alibi.” A little interesting fact from the Innocence Project states that “A checkout tape put the purchase at 5:13 p.m. Beernsten put the …show more content…
Every time, he was denied. In 1995, a petition for DNA testing on Beernsten’s fingernails was granted and it showed that the fingernails contained DNA of an unknown person. This didn’t completely eliminate Avery from the running, but it meant that another person could have done this crime. The Innocence Project also states that “In April of 2002, attorneys for the Wisconsin Innocence Project obtained a court order for DNA testing of 13 hairs recovered from Beernsten at the time of the crime”. With this new DNA that the FBI was able to test on, it linked the hair to a man named Gregory Allen, who was a convicted felon who looked like Steven Avery. “Allen was then serving a 60-year prison term for a sexual assault in Green Bay that occurred after the attack on Beernsten” (InnocenceProject.org). Avery was released from prison on September 11, 2003 after serving 18 years. Because of his wrongful conviction and losing all of that time in his life, he filed a federal lawsuit against Manitowoc County, their sheriff, Thomas Kocurek, and their district attorney, Denis Vogel for 36 million dollars. In 2006, the lawsuit was settled for $400,000. This was only the beginning of Avery’s

In response, Calumet County was brought in to take the lead in the investigation. However, Manitowoc County still participated in searches and investigation, and even turned up key evidence in the case. Much of the evidence was circumstantial, until March 2, 2006 when Avery’s nephew, Brendan Dassey, confessed to have assisted Avery in raping and murdering Teresa Halbach. Dassey, who is intellectually challenge, was coerced into confessing, which was evident in the confession tapes.…

The Wrongful Conviction of Steven Truscott It was the evening of June 9, 1959 when 14-year-old Steven Truscott had been seen giving 12-year-old classmate, Lynne Harper, a ride on the handlebars of his bike (Makin, 2016). The two separated at the intersection of County Road and Highway 8 (Harland-Logan, n.d.), only for Harper’s father to report his daughter missing shortly after (Harland-Logan, n.d.). Her body was found near a wooded area called Lawson’s Bush on June 11, 1959 (Makin, 2016), and she had been sexually assaulted and strangled to death (Harland-Logan, n.d.). Four days later, Steven Truscott was charged with the murder of Lynne Harper (Harland-Logan, n.d.).…

The one-cent coin was the first piece of currency authorized by the United States government in 1793. Also included was the half-cent, dime and quarter-dollar. Today, one will probably not recognize the name or face of the half-cent. This is because it was discontinued in 1857 due to its lack of value and failure to facilitate trade. In recent years, the penny has taken to many of the same effects the half-cent had in the mid-1800’s.…

Wrongful Conviction On the morning of August 10, 1984, Deborah Sykes was brutally stabbed, sexually assaulted, and eventually killed in Winston-Salem, North Carolina. The man convicted for her murder was Darryl Hunt, a 19 year old boy that would go on to spend 20 years in prison for a crime he did not commit. Hunt was convicted based on eye-witness testimony and informants, but was later exonerated based on DNA evidence that matched a man that was caught just a few months after the murder took place. This case is an exemplar of the strength of DNA evidence and the fragility of eyewitness testimony.…

In a school in Detroit a teacher by the name of Tiffani Eaton tried to stop a fight between two students by hitting both of them with a broom. Because of her actions the school fired her, the students were suspended. In my opinion her punishment was unjustified, although I can understand the other side of the coin. She did cause the students physically and mentally harm. As well as brook the schools policy by not getting security and hitting a student.…

Dred Scott was slave who sued for his liberty in the Missouri courts, arguing that four years on free soil had made him free. He was once owned by army surgeon John Emerson. Dred Scott’s attorney argued that between 1831 and 1833, John Emerson had taken Scott with him during various military postings to areas where the Missouri Compromise banned slavery, making Dred Scott a free man. When nearly after six years in the Missouri courts, the state Supreme Court rejected this argument in 1852, Dred Scott, with the help of abolitionist lawyers, appealed to the United States Supreme Court. In a 7 to 2 decision, the Court ruled against Dred Scott.…

The defenders of Avery commonly claim the Manitowoc police department framed Avery because of his lawsuit , yet they are wrong. Officers Lenk and Colborn were not in Avery's lawsuit, thus the county was not being sued for $36 mil it was Vogel and Kocourek Who were now retired that were being sued and it was not the counties insurance which refused to pay but instead it was Kocourek’s personal Insurance. This just goes to prove the county of manitowoc had no motive to frame Avery. Other defense theories claim that blood was planted and the bones discovered in the burning pits were planted ; however how could the evidence have been planted inside of the Rav4 and inside of the fire pits without being discovered , after all the FBI’s test would have detected EDTA, a preservative used in blood samples.…

Judicial murder made by inequity legal system In the month after “Making a Murderer” premiered on Netflix, more than 129,000 Americans signed a petition to pardon Avery and Dassey for their convictions to the murder of Halbach and in the book ‘in cold blood’ written by Truman Capote, the two murderers were treated by ignoring the mental problem influence of theirs, they stayed in prison for five years and were finally performed death penalty. After reading the book and watching the TV show, I think these crimes sufficiently prove that there is a fundamental inequity at work in countless branches of legal system. Making a Murderer tells a story about the life of Steven Avery, who was convicted of rape in 1985 and imprisoned for 18 years, despite…

This individual, one Gregory Allen was apparently operating rather openly in the Manitowoc area to the point where he was under constant surveillance by the City of Manitowoc Police Department. However, on the day of Beernsten’s attack, surveillance on Allen was suspended for most of the day as the department needed reinforcements for other investigations. An officer from the police force, Thomas Bergner, approached Sheriff Kocourek concerning this suspension and the possibility of correlation to Beernsten’s attack, but Kocourek dismissed it and insisted that they had their perpetrator in custody. Three other women working under District Attorney Denis Vogel also discussed the possibility of the actual criminal being Allen, due to their familiarity with his record, but he also ignored them. The most glaring error made in this investigation was the fact that the entire team overlooked or blatantly…

THE CASE AGAINST RALPH ARMSTRONG In late 2015, Wisconsin’s criminal justice came to the fore of the nation’s public consciousness with the Making a Murderer documentary series. The series detailed the handling of Steven Avery’s murder case in 2007 and how it related to his exoneration in an earlier wrongly convicted rape case in 1985. Both of his cases fell under a heavy cloud of doubt in the veracity of the investigation, the validity of the charges against him and the trial that imprisoned him.…
