The defenders of Avery commonly claim the Manitowoc police department framed Avery because of his lawsuit , yet they are wrong. Officers Lenk and Colborn were not in Avery's lawsuit, thus the county was not being sued for $36 mil it was Vogel and Kocourek Who were now retired that were being sued and it was not the counties insurance which refused to pay but instead it was Kocourek’s personal Insurance. This just goes to prove the county of manitowoc had no motive to frame Avery. Other defense theories claim that blood was planted and the bones discovered in the burning pits were planted ; however how could the evidence have been planted inside of the Rav4 and inside of the fire pits without being discovered , after all the FBI’s test would have detected EDTA, a preservative used in blood samples. If the blood samples taken from the car contained EDTA it would have proved they were planted from a vial , however the blood found in the RAV4 did not contain the preservative , as for the bones found in the fire pit , there is no way the Manitowoc police department could have planted those without being discovered by Calumet County detectives , the FBI , and other agencies , and lastly the calling in of the plate numbers by Andrew colborn. Colborn was simply following standard police protocol when he called in the license plate. Calumet Counties Mark Wiegert Had called him that evening and asked for help with a missing person case, Wiegert specifically asked Colborn to investigate Teresa Halbach's last known locations which were in Manitowoc county , Wiegert gave colborn the information such as the plate numbers and He ran them which is of course standard police protocol in a missings persons case , when a person goes missing the police check plates numbers through dispatch and dispatch checks through with the Department of Motor Vehicles. looking at this information and using it to counter Avery's defense we can

After reviewing Zack Anderson’s case, I cannot help but feel sorry for the poor guy. When reading over the basic facts of the case we know for a fact that Anderson had met the fourteen year old girl in Michigan who posed as a seventeen year old on a dating site meant for those who were of the age of consent, who could then meet up for sex. When Anderson had met the girl, and without the use of force, had sex with her, by doing so he unknowingly committed statutory rape due to the girl lying about her age. While yes in some states some can claim as a defense that they were truly unaware of her age, however in our text book states that a “defendant strictly liable even if he made a reasonable inquiry in good faith to determine the victim’s…

From the very beginning of this move during the initial investigation of the crime scene, which is when detectives arrive on scene to try and piece together what happened, I can already see that the detectives are not following proper procedure in handling evidence. When evidence is collected at a crime scene; protocol says it should be handled with gloves to prevent contamination and preserved in plastic bags that are supplied by the department to start the chain of custody. “The use of latex gloves or disposable forceps when touching evidence often can prevent such problems” (Saferstein, 2011) such as contamination. The chain of custody is the procedure of transferring evidence between parties by logging who is taking custody of the evidence and when. Later in the movie they show the detectives all huddling around the crime scene without care which could have contaminated evidence in the vicinity.…
