Search/sweeps

Search- an entry or intrusion by a government agent on a quest for evidence into an area where an individual has a reasonable expectation of privacy.


Need probable cause to conduct a search unless the person controlling the area where there is reasonable expectations of privacy consents to the search, or the entire vessel is subject to a customs and border search and access to the area is reasonable under the circumstances

Reasonable suspicion

The belief by a reasonable and prudent person based on articulable facts that something has happened

Probable cause

The level of suspicion that would cause a reasonable and prudent person, given the overall circumstances, to believe a crime has been or is being committed

Frisk

The crushing and passing of hands over the outer clothing of a person in search of weapons.


Reasonable suspicion that the detainee may have a weapon, and that either the officer or others may be endangered

Body cavity search

"Visual or physical examination into the body cavity."


Can we conduct a visual/physical search?


Yes but only visually. During visual examination, the persons being searched should be requested to manipulate their own bodies to permit adequate visual examination. If the visual examination reveals a suspicious object, the person should be requested to remove the object. If he/she refuses, removal by the examiner is not authorized.


Who can conduct a body cavity search?


A physical body search can be conducted only be a licensed physician under clinical conditions. If not available, person should be kept under observation. If a physical cavity body search is immediately necessary due to medical reasons, it must be done by available medical personnel using standard medical procedures.


What level of suspicion is required?


Reasonable suspicion(weapon,evidence or means of escape)

BISS

basic initial safety sweep is " a quick and limited protective inspection of a vessel for boarding team safety"


How is it different from a search?


It is not a quest for evidence, and does not entail intrusion of areas where one could expect a reasonable expectation of privacy( unless an officer must transit through such a space to check bildge access)


What is the scope of a BISS?


it's a scope is determined by the circumstances of the boarding, particularly the size, type and condition of vessel. Ideally check for unsecured lines/nets/leaking barrels or canisters, damaged deck plates, flooded bildges, damaged ladder wells, engine room, leaks, ect

EISS

Extended initial safety sweep is conducted only when reasonable suspicion exists that there is a particular hazard that may threaten the boarding team. Usually unaccounted personnel, known weapons ( of location is not known, EISS is not authorized, instead, frisk an area of the boat and muster the crew there to prevent access to said weapons to promote safety of the boarding team


Known safety hazards, the scope of an EISS is guided by the suspected hazards. Boarding team members conducting BISS OR EISS should not simultaneously conduct these sweeps with other activities such as evidence gathering or boating safety activities.

Active information gathering

Gathering information for the duration of the boarding through casual conversation. If suspicions arises, the boarding team can come up with a list of questions to ask people separately, then compare information afterwards to possibly establish probable cause.

Confined space entry/ radiation

Large enough for a person to enter and perform work, has limited or restricted means of entry or exit. It's not designed for continuous human occupancy, may have one or more of the following characteristics. Contains or may have protection to contain hazardous atmosphere. Contains or may have the potential of engulfing an entrant. Contains a material that has the potential of engulfing an entrant. Has an internal configuration such that an entrant could be trapped or asphyxiated or by inwardly converging walls or by a floor that slopes downward and tapers to a smaller cross section, or contains any other recognized serious safety or health hazards
