Collective Bargaining
The negotiation of labor agreements and their administration during the period in which they are in effect. The collective aspect of collective bargaining is the exclusive representation by the union of the collection of people in a bargaining unit.
24 hour rule
The NLRB rule forbidding union and management campaigning in certification elections in the last full day before the election.
Alternative dispute resolution
Calls for a resolution of a dispute using an eternal source such as a mediator or magistrate. Includes dispute resolution processes and techniques that act as a means for disagreeing parties to come to an agreement short of litigation.

Examples of ADR are: open-door policy, mediation, peer review system, etc.
Open-door policy
A "standing invitation", and a genuine one, for employees to raise their concerns with managers and/or human resources, face to face. The use of an "open door" cannot result in penalties, formal or otherwise, against those employees who avail themselves of this resource.
Ombudsperson
Person employed by a company to help resolve personal disputes.

The ombudsperson functions as a "go-between" between the aggrieved employee and the company manager.

Does not have independent authority to impose a resolution of the dispute but attempts to find a "common ground" on which all parties can agree.
Peer review system
Only option that involves employees in the decision-making process, therefore is the only ADR process that provides professional development opportunities.
Conciliation
A settlement agreement between parties achieved by the EEOC when a charge is filed with them
Fact-finding
Neutral party who studies the issues in a dispute and makes a public recommendation for a reasonable settlement.

The fact finder's purpose is to assess the facts and to organize and display them publicly in the hopes that the public will find the fact-finder's conclusions and recommendations to have merit and bring pressure on the parties in dispute to settle their differences.
Tort
Refers to the body of common law that allows an injured person to obtain compensation from the person who caused the injury

Tort claims relevant to employment law include negligence, defamation, invasion of privacy, infliction of emotional distress, and wrongful discharge in violation of public policy.

Business agents ensure that contracts are being followed and refer members to available employment. Business agents move between employers as work is finished on one project and becomes available on another.
What are the two major committees which operate within most locals and what are their roles?
The two major committes are the executive committee and the negotiation committee.

The executive committee establishes local policy and the negotiation committee reviews members' grievances and negotiates with management over grievances and contract changes.
