In order for things to go smoothly and repair the damaged relationships, significant aspects need to be maintained within the interactions of the stakeholders in the form of a restorative justice process. First would be the concept of authentic communication that upholds the same elements as discussed in the encounter. Each party in the criminal case is accountable in sharing their perceptive on how decisions on this case should be made. Accountability can serve as a check and balance system of power, in which no one party is able to dominate the other. An apology is not just a simple I’m sorry then it done with, it includes three elements to show your sincerity. The first element is an acknowledgement, “there is an admission that a norm was violated and that the person making the apology is the one responsible for the violation” (Ness& Strong, 2015, 101). The second element is affect, being able to show your regret or shame for the actions committed. The third element is vulnerability, wanting to get across idea of the power being stripped from the offender and given back to the victim. All three elements help an apology to come off as genuine and are capable of gaining forgiveness from other stakeholders. Making an amends simply cannot undo the past, but it helps to take steps to repair the harm caused.
