Cautioning relevant persons about right to silence

"Before I ask you any questions I must tell you that you have the right to remain silent.
This means you do not have to say anything, answer any question or make any statement unless you wish to do so.


However, if you do say something or make a statement, it may later be used as evidence.

Right to communicate with friend, relative or lawyer

"You have the right to telephone or speak to a friend or relativeto inform that person where you are and to ask him or her tobe present during questioning.


You also have the right to telephone or speak to a lawyer ofyour choice to inform the lawyer where you are and to arrangeor attempt to arrange for the lawyer to be present duringquestioning.


If you want to telephone or speak to any of these people,questioning will be delayed for a reasonable time for thatpurpose.

Breath test requirement

You have been stopped for [outline the reason e.g. random breath test]. I now require you to provide a specimen of breath for a breath test.




This is a breath testing device. To comply with my requirement, I direct you to place your mouth over the mouthpiece of the device & blow directly & continuously through that mouthpiece until told to stop by me. Commence blowing now.

Positive result of breath test

This test indicates to me that you are over the [no alcohol limit or general alcohol limit, whichever is applicable in the circumstances] & you are required to accompany me to a [state whether a police station, hospital, doctor's surgery, vehicle, vessel or other place] for the purpose of further tests.
