What is a Paramount principle of Oranga, Tamariki act 1989

The well-being and best interest of the child / young person

Oranga Tamariki Act 1989 Section 42 - Search without warrant

Must be critically necessary - that if you leave the location, injury or death may occur.


Entering must produce evidence of ID state you are using section 42 of the OT act.


You must inform the commissioner of the use of this power within three Days.

Oranga Tamariki Act 1989 - Section 39 - Place of safety warrant

Any authorised person may enter and search a dwelling if they believe on reasonable grounds, that a child or young person has suffered was likely to suffer ill-treatment, serious, neglect, abuse, serious deprivation.


Child will be placed with OT


Report must be given to the commissioner

Oranga Tamariki Act 1989 - Section 48 - Child or young person found unaccompanied

Child or young person is found, and accompanied in a situation in which this physical or mental health, is being all likely to be impaired. Constable may can take child (MUST GIVE THEM THERE RIGHTS).


And with the consent, deliver them to the custody of the parent or guardian who normally cares for them.


If no consent given or caretakers are unwilling to take them place the child - child will be put in custody of OT.

Child left unaccompanied under the age of 14.

Abuse (mentally/physically emotionally or sexually)


Deprivation


Neglect


Exposure to family violence
