If a health care practitioner fails to repay student loans or comply with scholarship service obligations their name and other info is compiled into a monthly report by the US Department of Health & Human Services. The Department then initiates an investigation, including financial and educational information, to determine the appropriate penalties for prosecution. An annual report is administered by Legislature that reports all the fines collected along with the prosecution handed down for each practitioner

The department shall investigate any complaint that is proved to be legally sufficient if it is filed in writing and signed by a complainant or a written complaints submitted anonymously.

A complaint is found to be legally sufficient if it contains ultimate facts that show a direct violation of any of the practice acts or rules relating to the professions regulated by the department. The department will investigate all sufficient cases regardless of the claimant’s anonymity or if the claimant withdrawals their complaint. If the complaint is found to be sufficient… it will be investigated!

The department shall issue an emergency suspension on the licenses of any health care
provider who pleads guilty, convicted of, found to be guilty or enters a nolo contendere regardless of adjudication for (a) all felonies (b) misdemeanor or felony against the medicaid program

) If the board has found the practitioner to previously have violated the provisions of treatment of 3+ patients and the probable cause panel finds additional violations, it is then reviewed by the Surgeon General to determine if an emergency suspension or restriction is warranted.

The Department may issue an emergency suspension or restriction on any license of any health care practitioner who tests (+) for any drug on any government or private sector pre employment or employer ordered & confirmed drug test. The practitioner has 48hrs from the time of notification to produce a lawful prescription for the drug producing positive results.

) Upon receipt of info that any health care provider has defaulted on any portion of their student loans or scholarship services, the Department will notify the licensee by certified mail informing them they are subject to license suspension if they do not furnish new payment terms and be in good standings within 45 days. If the licensee fails to respond or comply within the 45 days, there is an immediate suspension on the license.

If any criminal proceedings are brought upon any licensed health care practitioner, a representative from the Department may voluntarily make recommendations regarding conditions of probation or any other assistance that will help promote justice and safety of the public. The court may order a representative of the Department to appear on any criminal cases and especially for those substantially related to the qualifications, functions, or duties of a licensed health care provider.

For professions that do not have an impaired practitioners act in their practice act, the department shall appoint an approved impaired practitioners program under this section.
